Fair Housing Act
The Fair Housing Act of 1968 prohibits discrimination of any form in housing. The Office of Fair Housing and Equal Opportunity (FHEO) in conjunction with The United States Department of Housing and Urban Development (HUD) and The NYC Commission on Human Rights (CCHR) and The NYS Division on Human Rights enforce compliance with this law. It prohibits discriminatory practices in housing by owners, landlords, and managing agents such as:
Refusal to rent or sell housing
Refusal to negotiate for housing
Make housing unavailable
National origin or religion
Set different terms, conditions, or privileges for sale or rental of a dwelling
Provide different housing services or facilities
Falsely deny that housing is available for inspection, sale or rental
More precisely, landlords cannot choose to engage in these practices with a potential tenant due to the person's:
Race, color, or gender
Disability
Deny a dwelling
Familial status (including children under age 18 living with parents or legal custodians, pregnant women and people securing custody of children under the age of 18)
You have one year after an alleged violation to file a complaint. However, you should file a soon as possible if you feel that your rights have been violated.
