LEASE RIDER

 

All NYC Rent Stabilized Initial & Renewal Leases MUST have attached to the back a copy of the “official” HCR Lease Rider.  IF the Rider is not attached it may result in a fine or other sanctions to the Landlord.  The Lease Rider should contain all the current updates to the Housing Laws.  You should check the date in the lower left hand corner of the Rider.  The most current Rider should have the date RA-LR 1(1/24).  This Rider reflects all the current legislation that was passed 6/14/19. The Rider is 12 pages long. On the lower right hand corner it will have the page numbers - Page 1 of 12, Page 2 of 12, and so on.

 

The Rider is meant to make tenants aware of the Housing Regulations and to help the Owners remember what has been changed. We realize the 12 page document can seem intimidating but it is meant to be informative.

 

HCR requires that the Rider be translated into six (6) languages – the translation(s) are available on their website.

MAJOR CAPITAL IMPROVEMENTS

 

Major Capital Improvement rent increases are prohibited in buildings that contain 35% or fewer rent regulated apartments.  That would happen if the building converted to coops/condos and the rent regulated tenants moved out over time thus decreasing the number of rent regulated tenants left in the building. The key is rent regulated tenants because in some coops/condos there are units being rented by individual owners – those units are not rent regulated.  Be aware!

 

Building must be clear of both B and C violations.

 

The tenants get sixty (60) days to respond to the owner’s application.  Take this opportunity and respond!
